Welcome to FINAL ARCHIVE! The terms “we”, “us” and “our” refer to FINAL ARCHIVE. FINAL ARCHIVE operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). FINAL ARCHIVE is powered by Shopify, which enables us to provide the Services to you.
The following Terms of Service, together with our Refund Policy and Privacy Policy (collectively, the “Terms”), govern your access to and use of our Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms. If you do not agree, you should not use or access our Services.
1. Eligibility & Accounts
To use our Services, you must be at least the age of majority in your country of residence. You agree to provide accurate and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials.
2. Products
• All products are made to order. Minor deviations in color or appearance (e.g. due to device displays or materials) do not constitute defects.
• We reserve the right to discontinue products or make changes to improve quality.
3. Orders & Contract Formation
• By placing an order, you make a binding offer to purchase.
• A purchase contract is concluded when we confirm your order by email.
• Orders are processed only after payment is received.
• Purchases are subject to our Refund Policy.
4. Prices & Payment
• All prices are listed in EUR and include VAT, unless otherwise stated.
• Payment methods are shown at checkout.
• You agree to provide current, complete and accurate payment information.
5. Shipping & Delivery
• Production time: usually 7–10 business days, as items are made to order.
• Delivery within the EU: approx. 3–5 business days after production.
• International shipping times may vary.
• We are not liable for delays caused by carriers, customs or events beyond our control.
• Risk passes to you once the goods are handed over to the carrier.
6. Right of Withdrawal
Consumers within the EU have a statutory right of withdrawal of 14 days (see our Refund Policy).
The right of withdrawal does not apply to goods custom-made or clearly tailored to personal needs (e.g. special frame sizes, custom passepartouts).
7. Returns & Damages
• Customers bear the direct costs of returning goods.
• Returned goods must be in original condition and packaging.
• If products arrive damaged, notify us within 7 days of receipt with photographic evidence. We will provide either a replacement or refund.
8. Intellectual Property
All content, photographs, text, and designs on this website are the intellectual property of FINAL ARCHIVE or our licensors. They may not be used without prior written consent.
9. Limitation of Liability
• We are liable only for intent and gross negligence.
• Liability for minor negligence, indirect or consequential damages, or loss of profit is excluded to the extent permitted by law.
• We are not responsible for damage resulting from improper use (e.g. incorrect hanging, exposure to humidity or sunlight).
10. Governing Law & Jurisdiction
• These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• If you are a consumer within the EU, the mandatory consumer protection laws of your country of residence apply in addition.
• Jurisdiction for business customers is Hartberg, Austria.
11. Severability
If any provision of these Terms is held invalid, the remaining provisions remain in full force.
12. Changes to Terms
We may update these Terms from time to time. The version published on this page at the time of your order applies.
